Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and the developer of TwiX("we", "us", or "our") regarding your use of the TwiX mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

For iOS users, this agreement supplements Apple's Standard End User License Agreement (EULA). In the event of any conflict, these Terms take precedence.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for personal, non-commercial purposes and in accordance with these Terms.

You may not:

• Copy, modify, or distribute the App or its content.
• Reverse-engineer, decompile, or disassemble the App.
• Use the App in violation of Twitch's Terms of Service.
• Sell, resell, or sublicense the App.

2. Subscriptions & Purchases

The App may offer auto-renewable subscriptions that unlock premium features. By purchasing a subscription, you agree to the following:

Billing & Auto-Renewal

• Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually as selected) unless cancelled at least 24 hours before the renewal date.
• Payment is charged to your Apple ID account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
• Subscription prices are displayed in your local currency at the time of purchase and may vary by region.

Free Trials

If a free trial is offered, you will not be charged during the trial period. After the trial ends, your subscription will automatically convert to a paid subscription unless cancelled before the trial expires.

Cancellation

You can manage and cancel your subscriptions in your device's App Store account settings. Cancellation takes effect at the end of the current billing period; you will retain access to premium features until that date.

Refunds

All purchases are made through Apple's App Store. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. We are unable to process refunds directly.

3. Third-Party Services

TwiX is an independent third-party client and is not affiliated with or endorsed by Twitch Interactive, Inc. The App uses the official Twitch API and APIs from 7TV, BetterTTV (BTTV), and FrankerFaceZ (FFZ) to provide its functionality. Your use of Twitch through this App is additionally governed by Twitch's Terms of Service and Privacy Notice.

The App may also integrate third-party SDKs for advertising and crash reporting (e.g., AppLovin MAX, Bugsnag). These services operate under their own privacy policies and terms.

4. User Conduct

You agree not to use the App to:

• Violate any applicable laws or regulations.
• Harass, abuse, or harm other users.
• Circumvent or attempt to bypass any authentication or security measures.
• Interfere with or disrupt the App or related services.

5. Intellectual Property

All content, design, and code within the App (excluding Twitch-provided content) are the property of the developer and are protected by applicable intellectual property laws. "Twitch", Twitch logos, and related trademarks are the property of Twitch Interactive, Inc.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We are not responsible for any interruptions to Twitch's services or content availability.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Changes to These Terms

We may occasionally update these Terms, and the most recent version will always be available on this page. We recommend reviewing these Terms periodically. Changes become effective when posted on this page.

10. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in a court of competent jurisdiction.
